- Transactional Matters
Benjamin Suess has extensive legal experience in litigation and transactional matters. He has worked in-house and in private practice, offering a comprehensive legal service similar to that of an "outside" general counsel. Mr. Suess practices in federal and state courts, as well as arbitration forums such as FINRA, JAMS and AAA. He advises a diverse range of clients, from small and mid-sized companies to high net worth individuals, across various industries including internet and technology, finance and securities, media, and manufacturing.
Mr. Suess is a proactive attorney who strategically utilizes litigation mechanics and court procedures to benefit his clients. His areas of experience include corporate governance, breach of contract, partnership disputes, misappropriation of trade secrets, employment and executive compensation, finance, securities and broker-dealer matters, procurement and government contracting, and intellectual property and licensing.
He has achieved significant accomplishments. These include decertifying two class action matters under the Fair Labor Standards Act. He also successfully reversed the grant of summary judgment and asserted a claim for negligent retention over Canon USA. Additionally, he defeated a motion for summary judgment by the U.S. Securities & Exchange Commission. Lastly, he reversed a finding of "nonresponsible" and successfully rehabilitated a client for government contracting.
Mr. Suess graduated from Tulane University in 1991. He obtained his J.D. degree in 1999 from the Benjamin N. Cardozo School of Law at Yeshiva University. He is admitted to practice law in the courts of New York and New Jersey. He is also admitted to the United States District Court for the Southern and Eastern Districts of New York and the United States District Court of New Jersey.
Prior to attending law school, Mr. Suess worked as an associate producer in sports television. He received an Emmy Award for his exceptional work on the 1995 Ironman Triathlon and 1998 Wimbledon broadcasts. In his free time, you can find Mr. Suess playing tennis.
