Benjamin Suess has a broad range of legal experience in both litigation and transactional matters. Having worked both in-house and in private practice, Mr. Suess provides a comprehensive, holistic legal service to his clients much like an "outside" General Counsel. Mr. Suess practices in federal and state courts, and various arbitration fora including FINRA, JAMS and AAA. Mr. Suess counsels diverse clients from small and mid-size companies to high net-worth individuals in all manner of business including internet and technology to brick and mortar such as finance and securities, media and manufacturing. Mr. Suess is a pro-active attorney, leveraging litigation mechanics and court procedure for the benefit of his clients.

Among his areas of litigation and transactional experience is corporate governance; breach of contract and UCC; partnership disputes including minority dissolution proceedings; misappropriation of trade secrets; non-compete/solicitation/disclosure; employment and executive compensation; finance; securities and broker-dealer matters; procurement and government contracting; and intellectual property and licensing.

Significant achievements include: decertifying two class action matters under the Fair Labor Standards Act; reversing on appeal the grant of summary judgment and asserting a claim for negligent retention over Canon USA; defeating a Securities & Exchange Commission's motion for summary judgment; and reversing a finding of "non-responsible" and rehabilitating a client for government contracting.

A 1991 graduate of Tulane University, Mr. Suess received his J.D. degree in 1999 from the Benjamin N. Cardozo School of Law at Yeshiva University. Mr. Suess is admitted to the practice of law in the courts of the States of New York and New Jersey; the United States District Court for the Southern and Eastern Districts of New York and the United States District Court of New Jersey. Prior to entering law school, Mr. Suess was an associate producer in sports television and won an Emmy Award for his work on the 1995 Ironman Triathlon and 1998 Wimbledon broadcasts. When he is not in court or counseling clients, you can find him on the tennis court.
